Terms of Service

Agreement to Terms

By accessing or using the services provided by TheBluLabel ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

TheBluLabel provides digital services including but not limited to:

• Landing page design and development
• Business website design and development
• Automation solutions and scripts
• Custom web applications and software
• Website maintenance and support
• White-label development services for agencies

Project Scope and Orders

Direct Orders

For clearly scoped services (landing pages, standard websites), you may place orders directly through our Stripe payment links. By completing payment, you agree to provide all necessary project information through our intake form.

Discovery Calls

For custom or complex projects, a discovery call is required to properly scope the work. Following the call, we will provide a detailed proposal outlining deliverables, timeline, and pricing.

Scope Changes

Any changes to the agreed project scope must be discussed and approved in writing. Out-of-scope work will be quoted and billed separately.

Payment Terms

Standard Payment Structure

Unless otherwise agreed:

• 50% deposit is required upfront to begin work
• 50% final payment is due upon project completion and delivery
• All payments are processed securely through Stripe

Monthly Plans

Monthly subscription plans are billed in advance on a recurring basis. Deliverables are allocated per month as outlined in your chosen plan tier.

Important: Monthly deliverables do not roll over. Any unused deliverables expire at the end of each billing period and cannot be carried forward to subsequent months.

Annual Plans

Annual subscriptions receive a 20% discount and are billed upfront for the full year. The same no-rollover policy applies to annual plans on a monthly allocation basis.

Late Payments

Late payments may result in project delays or suspension of services. We reserve the right to charge interest on overdue invoices.

Revisions and Approval

Standard projects include two revision rounds. Revisions must be requested within the agreed review period and should be based on the original project scope.

Additional revision rounds beyond what is included in your package will be billed separately. Major changes or new requirements constitute out-of-scope work.

Project Timeline

We provide estimated timelines for all projects. Actual delivery dates depend on:

• Timely provision of required materials and information
• Prompt feedback during review stages
• Project complexity and scope
• Current workload and queue position

Delays caused by client-side factors may extend the delivery timeline accordingly.

Client Responsibilities

You agree to:

• Provide accurate and complete project information
• Supply necessary content, assets, and access credentials in a timely manner
• Respond to requests for feedback within agreed timeframes
• Ensure you have rights to all materials provided to us
• Make timely payments as per the agreed schedule

Intellectual Property

Ownership Transfer

Upon receipt of full payment, you will own the final deliverables created specifically for your project. This includes custom designs, code, and content we create for you.

Pre-existing Materials

We retain ownership of any pre-existing code, frameworks, tools, or methodologies used in your project. You receive a license to use these as part of your delivered project.

Portfolio Rights

We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing. For white-label projects, we will respect confidentiality requirements.

Cancellations and Refunds

Project Cancellation

You may cancel a project at any time by contacting us at support@theblulabel.com. Refunds will be calculated based on work completed to date.

Refund Policy

• Deposits are non-refundable once work has commenced
• If we cannot deliver the agreed service, a full refund will be provided
• Partial refunds may be issued for cancellations based on work completed
• Monthly subscription cancellations take effect at the end of the current billing period

Warranties and Disclaimers

We warrant that services will be performed in a professional manner consistent with industry standards. However:

• We do not guarantee specific business results or outcomes
• We are not responsible for content you provide
• Third-party services and integrations are subject to their own terms
• We cannot guarantee uninterrupted or error-free operation of delivered work

Limitation of Liability

To the maximum extent permitted by law, TheBluLabel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service in question.

Maintenance and Support

Post-launch support and maintenance are available as separate services. Unless explicitly included in your package, ongoing updates, hosting, and technical support are not included in the base project price.

Confidentiality

We will keep confidential any proprietary information shared during the course of our engagement. Both parties agree not to disclose confidential information to third parties without prior written consent.

Termination

Either party may terminate the agreement with written notice if:

• The other party breaches these terms and fails to remedy within 14 days
• The other party becomes insolvent or ceases business operations
• Continuation of the project becomes impractical or impossible

Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with applicable laws.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
